Muhammad Khan and others V. Additional Sessions Judge, Chaman and others,
PLJ 2017 Quetta 12 · Balochistan High Court
This case involved two related petitions concerning the death of a young woman, Bibi Khatima, allegedly murdered by her husband and relatives. Her cousin and later her father approached the police and Levies authorities asking them to register a criminal case (FIR) alleging murder, but the authorities refused, apparently believing the allegations were false. Both then went to an Ex-Officio Justice of Peace under section 22-A of the Criminal Procedure Code seeking an order directing registration of the FIR, but the Justice of Peace dismissed their applications. They challenged that dismissal before the Balochistan High Court.
The High Court ruled in favor of the petitioners. It held that under the law, police or Levies officials have no authority to judge the truth or falsehood of a complaint before registering it—if the information discloses a cognizable offence (like murder), they are legally bound to record an FIR immediately and investigate afterward, not before. The Court found that no proper investigation had been conducted, and that the Justice of Peace had misunderstood his role by essentially assessing the merits of the complaint instead of simply checking whether it disclosed a cognizable offence.
The Court accepted both petitions and directed the police to register the FIR against the accused persons.
This case matters because it reinforces a fundamental principle of criminal procedure: authorities cannot refuse to register complaints of serious crimes based on their own assessment of credibility, protecting complainants' right to have allegations formally investigated.
