cases where the decree/ order of a forum below has been affirmed by the higher forum on merit, both on point of fact and law, we feel no hesitation in holding, that it would be such decree/ order (appellate or revisional) of the higher forum, which will be final, for the purpose of Section 12(2), C.P.C., and application thereunder shall be maintainable and competent before that Court.” In view of the above, dictum laid down by the Hon’ble Apex Court, I am of the view that the appellate Court has rightly held that a fter affirmation of the judgment and decree of the trial Court by the appellate Court on merits, the judgment and decree of the appellate Court will be final judgment and decree for the purpose of Section 12(2), C.P.C. and the same can be assailed before the appellate Court by means of filing application under Section 12(2), C.P.C. 7. For what has been discussed above, instant revision petition having no merits is dismissed leaving the parties to bear their own costs. (Y.K.) Petition dismissed
