Rahim Muhammad alias Rohi Muhammad V. Syed Noor Shah,

PLJ 2017 Quetta 104 · Balochistan High Court

This case involves a landlord-tenant dispute over a shop (Cabin) in Quetta. The landlord, Syed Noor Shah, had earlier obtained an eviction order against his tenant, Rahim Muhammad, from the Rent Controller for default in rent and personal need, fixing the monthly rent at Rs. 16,000. That eviction order was upheld all the way up to the Supreme Court. Following this, the landlord filed a separate civil suit to recover arrears of rent amounting to over Rs. 1.4 million, which the trial court largely granted.

The tenant appealed, arguing that the rent amount had never been properly proven through documents or evidence, that the civil suit was not competent, and that recovery for rent older than three years was barred by the Limitation Act.

The Balochistan High Court rejected these arguments. It held that since the Rent Controller had already determined the landlord-tenant relationship and the rate of rent, and these findings had been upheld through the appellate process up to the Supreme Court, they could not be reopened or challenged again in a civil suit. The court also held that under Article 110 of the Limitation Act, 1908, the three-year limitation period runs from when each installment of rent falls due, so the suit filed in 2014 was within time.

The appeal was dismissed, reinforcing the principle that final findings of a Rent Controller on landlord-tenant relationship and rent rate are binding in later civil proceedings.
