PLJ 2017 · Lahore High Court (Multan Bench)
This case was an appeal against convictions for kidnapping for ransom under the Pakistan Penal Code and the Anti-Terrorism Act. Five people - Muhammad Javed, Raheem Zada alias Gul Khan, Abdul Hameed, Mst. Tabassam alias Robina, and Nawaz Khan - had been sentenced to life imprisonment by an Anti-Terrorism Court in Multan for allegedly abducting a young man, Usman Ahmad, and demanding one crore rupees in ransom from his father. The complainant also filed a separate petition asking the court to enhance the punishment to the death penalty.
On appeal, the Lahore High Court (Multan Bench) found the prosecution's case riddled with doubts. No witness had actually seen the victim with the accused. The prosecution could not even establish where the abduction took place, giving conflicting locations. The person who allegedly negotiated the ransom over the phone was never identified, and the victim could only vaguely describe his place of confinement as a "mud room," without further detail.
The court applied the well-established legal principle that in criminal cases, the burden of proof never shifts from the prosecution, and if even one reasonable doubt exists about an accused person's guilt, that benefit of doubt must go to the accused as a matter of right, not mercy. Finding multiple such doubts here, the court ruled the prosecution had failed to prove its case beyond reasonable doubt and allowed the appeals, overturning the convictions. This case reinforces how courts safe
