Litigation is notice to public at large
PLJ 2017 Lahore 740 · Lahore High Court
This case was about a land dispute in Bahawalpur. Faiz Ahmed had made an agreement in 2006 to buy a piece of land from Muhammad Ahmed and Muhammad Younas, paying earnest money and later more, with possession handed over to him. However, the sellers refused to formally execute the sale and later, while the court case was still pending, sold the same land to a third person, Muhammad Afzal, through a registered sale deed. Faiz Ahmed sued for specific performance of the original agreement and asked the court to cancel the later sale to Afzal.
The trial court and the lower appellate court ruled in favour of Faiz Ahmed, and the sellers and Afzal challenged this in the Lahore High Court through second appeals.
The High Court dismissed the objection that evidence recorded through a commission was defective, holding that since neither party had raised this procedural issue earlier, they could not raise it now. More importantly, the court rejected Afzal's claim that he was an innocent buyer unaware of the earlier agreement. It held that ongoing litigation is treated as public notice, and anyone buying property should be careful to check whether it is already under dispute. Since the agreement and lawsuit existed before Afzal's purchase, he could not claim to be a bona fide purchaser without notice.
This case reinforces an important property law principle: buyers must verify the legal status of land before purchasing, as pending litigation binds subsequent purchasers too.
