PLJ 2017 Lahore 720

PLJ 2017 Lahore 720 · Lahore High Court (Multan Bench)

This case involved a father seeking custody of his young son through Pakistan's family courts. The father, Shabir-ul-Hassan, had divorced the child's mother, Tanveer Zaidi, back in 2008. Years later, concerned that the mother was unable to properly care for the boy, possibly due to financial difficulties, health issues, and the fact that the child was actually being raised by his paternal aunt rather than his mother, the father filed a petition asking the court to give him custody.

The trial court heard evidence from both sides but rejected his request. When he appealed, the appeals court simply upheld that decision in a very brief, half-page ruling without properly explaining its reasoning.

The father then approached the Lahore High Court, arguing that the lower courts had mishandled the evidence and failed to think the matter through carefully.

The High Court agreed that something had gone wrong, not with the trial court, which had analyzed the evidence thoroughly, but with the appellate court, which had dismissed the appeal too quickly without explaining its reasoning or properly discussing the evidence. The judge emphasized that courts must always give clear reasons for their decisions, even when upholding a lower court's ruling, especially in sensitive matters like child custody.

As a result, the High Court set aside the appellate court's judgment and sent the case back for a fresh, more careful decision. This case highlights the importance of thorough, reasoned judicial decision-making, particularly in cases affecting children's welfare.
