Powers of Higher Education Commission

PLJ 2017 Islamabad 358 · Islamabad High Court

This case was about an educational institution called the Open International University for Complimentary Medicine, claiming to be based in Sri Lanka, which challenged its inclusion on a list of illegal or fake universities published by Pakistan's Higher Education Commission (HEC). The petition was filed by someone claiming to be its Vice Chancellor in Pakistan, who asked the Islamabad High Court to remove the university's name from the list and stop HEC from taking action against it.

The court examined HEC's powers under the Higher Education Commission Ordinance, 2002, and found that HEC has broad authority to collect and publish information about educational institutions, both within Pakistan and abroad, especially when such institutions solicit admissions from Pakistani students. The court noted that the petitioner failed to provide credible proof that the university actually existed, was a genuine degree-awarding institution, or that the person filing the petition had authority to do so. It also noted inconsistencies, such as a recognition letter referring to a differently named institution.

The court ruled that HEC acted within its lawful authority in publishing the list after conducting inquiries. However, it gave the university the option to approach HEC directly, or through Sri Lanka's regulatory authority, to prove the published information was incorrect, in which case HEC would be required to correct the list.

This case matters because it clarifies HEC's regulatory power to protect students from fraudulent or unrecognized institutions, including foreign ones operating in Pakistan.
