Second, on the merits, the court found no illegality or unfairness in HEC's refusal to grant the NOC, since real deficiencies remained unresolved. The court also criticized the college for admitting students without proper affiliation and without warning them of this risk, and noted that universities should decide on affiliation before, not during, an academic session. This case highlights the importance of institutions meeting regulatory requirements before enrolling students, and clarifies technical rules about who can legally bring a court case.
یہ مقدمہ اسلام آباد لا کالج کی جانب سے اسلامیہ یونیورسٹی بہاولپور (آئی یو بی) سے اپنے ایل ایل بی پروگرام کے لیے الحاق حاصل کرنے کی کوشش سے متعلق تھا۔ قانون کے تحت اس طرح کے الحاق کے لیے ہائر ایجوکیشن کمیشن (ایچ ای سی) سے این او سی (عدم اعتراض سرٹیفکیٹ) کا حصول لازمی تھا۔ کالج نے این او سی کے لیے درخواست دی، جس پر ایچ ای سی نے مختلف خامیوں کی نشاندہی کی جنہیں دور کرنا ضروری تھا۔ اگرچہ کالج نے دعویٰ کیا کہ اس نے ان مسائل کو حل کر لیا ہے، تاہم ایچ ای سی نے حتمی این او سی جاری نہیں کیا، اور کالج کی درخواستوں اور یاد دہانیوں کا کوئی جواب نہیں دیا گیا۔ دریں اثنا، کالج نے مطلوبہ این او سی یا الحاق حاصل کیے بغیر ہی تعلیمی سیشن 2015-16 کے لیے طلبہ کو داخلہ دے دیا تھا، اور اس نے اسلام آباد ہائی کورٹ سے رجوع کرتے ہوئے ایچ ای سی کو این او سی جاری کرنے کی ہدایت کی استدعا کی۔
