Dispute Regarding Amount of Dower

PLJ 2016 Sh.C. (AJ&K) 14 · Azad Jammu & Kashmir High Court

This case involved a husband, Tahir Hanif, appealing against a family court decision that ordered him to pay his wife, Saira Kosar, outstanding dower (mehr) and monthly maintenance. The couple had married with a dower amount of Rs. 5,00,000 fixed in the nikahnama. The wife claimed the full amount was still owed, while the husband argued he had already paid Rs. 3,00,000 worth of gold ornaments at the time of rukhsati, and that the remaining balance was "deferred dower," payable only if the marriage ended through death or divorce, not simply on demand.

The trial court had ruled in the wife's favor, ordering payment of Rs. 4,50,000 in dower plus Rs. 3,000 monthly maintenance. The husband appealed, arguing the trial court misread the evidence, especially regarding the gold ornament receipt and the nature of the deferred dower clause in the nikahnama.
