Preference cannot be given British Citizen Father ordinarily
PLJ 2016 SC (AJ&K) 239 · Azad Jammu & Kashmir High Court
This case involved a custody dispute over a young boy, born in 2006, whose parents had married and lived in England. According to the mother, the father sent her back to Azad Kashmir with the child and later divorced her. Both parents subsequently remarried and had children from their second marriages. The father, living in England, applied to a Family Court in Kotli and was granted guardianship in proceedings held without the mother present. When the mother challenged this and sought custody herself, both the Family Court and the Shariat Court ruled against her, apparently reasoning that the father's residence in England made him the more suitable guardian.
The Supreme Court of Azad Jammu and Kashmir overturned these decisions. It held that the welfare of the child must be the paramount consideration in custody matters, not simply where a parent lives. The Court noted the father had never paid maintenance for the child and had remarried with children from that marriage, and found that awarding custody to him despite these facts was not in the child's best interest. Citing its own precedent, the Court ruled that when both parents have remarried, custody should generally go to the mother. The Court also emphasized that if a child is old enough to express an intelligent preference, that opinion should be considered in deciding custody.
This judgment reaffirms that in custody disputes, courts must prioritize the child's actual welfare over assumptions based on a parent's location or financial status, and that a father's foreign residence does not automatically entitle him to preference.
