Procedure in case of Joint Trial of Challan and Complaint Case
PLJ 2016 SC 108 · Lahore High Court (Rawalpindi Bench)
This case concerns a murder trial where the person who filed the original police complaint (FIR) also filed a separate private complaint containing the same allegations against the same accused persons. The trial court decided to hold a joint, single trial covering both cases together, rather than trying the private complaint first and keeping the police case on hold, which is the procedure normally recommended by courts.
The accused were acquitted by the trial court, and the High Court upheld that acquittal. The complainant then approached the Supreme Court, arguing that the acquittal should be overturned because the trial court had wrongly combined the two cases instead of trying the complaint case first.
The Supreme Court agreed that the law generally requires the complaint case to be tried first when the same complainant brings both an FIR and a private complaint on identical allegations against the same accused. However, it held that a procedural irregularity like this does not automatically invalidate a verdict. Under Section 537 of the Criminal Procedure Code, a conviction or acquittal cannot be reversed merely because of an error in the mode of trial unless it actually caused a failure of justice. Since the petitioner never objected to the joint trial at any stage, and since the evidence against the accused (last-seen evidence, motive, and an alleged extra-judicial confession) was weak regardless of how the trial was conducted, the Court found no failure of justice had occurred. The petition was dismissed, and the acquittal stood. The case clarifies that procedural irregularities only matter if they genuinely affect the fairness of the outcome.
