Responsibility of NHA in road Accidents

PLJ 2016 · Sindh High Court

This case involved a woman who, while traveling with her husband and others from Karachi to Larkana on a national highway, met a serious accident when her car hit small crash stones scattered on the road near Tando Masti. There were no warning signs or cautionary boards, even though several similar accidents had reportedly happened at the same spot before. The petitioner and her companions were injured and her car was badly damaged. She approached the Sindh High Court asking that the National Highway Authority (NHA) and other authorities be directed to take proper safety precautions on highways and to compensate her for the losses suffered.

The court examined the NHA Act, 1991 and the National Highways Safety Ordinance, 2000, holding that NHA, as the body controlling and managing national highways, has a mandatory duty to ensure road safety, including placing proper traffic and warning signs, maintaining speed checks, and enforcing rules, not merely on paper but in practice. Since NHA collects toll tax on such roads, it cannot avoid its safety obligations. The court directed NHA to provide round-the-clock patrolling, establish emergency medical aid and ambulance facilities at toll points, and report compliance within a specified time.

However, the court held that it could not determine the actual compensation or damages in a constitutional petition, since that requires evidence-based findings. It therefore allowed the petitioner to approach a civil court for compensation.

This judgment is significant because it clarifies that highway authorities have an enforceable duty to ensure road safety, not just collect tolls.
