Misconduct of a Judicial Officer

PLJ 2016 · Lahore High Court

This case involved a civil judge who was removed from service after a surprise inspection found 356 of his case files incomplete. In 226 of these files, judgments or orders had been dictated and typed but never signed by him. In another roughly 50 files, no judgment or order existed at all. Despite this, he had issued succession and guardianship certificates and robkars (court orders) to release criminal offenders based on these unsigned or non-existent judgments. A departmental inquiry was held, and he was ultimately dismissed from judicial service. He appealed to the Punjab Subordinate Judiciary Service Tribunal, arguing the punishment was too harsh given his otherwise clean record, that no litigant had actually been harmed, and that staff failures (an inefficient stenographer) were partly to blame for missing orders.

The Tribunal rejected these arguments. It held that there is no legal concept of an oral or unsigned judgment being valid or enforceable, and that issuing certificates and release orders without proper signed judgments was a serious illegality, not a mere technical lapse. It found the judge had effectively invented his own improper procedure for granting relief without legal authority to do so. Given the sensitive and important nature of judicial work, the Tribunal ruled that such inefficiency and dereliction of duty deserved an especially strict standard, higher than for ordinary government employees. It upheld the removal from service as a proportionate penalty, dismissing the appeal.
