Clerical Mistake in Evidence
PLJ 2016 · Lahore High Court (Multan Bench)
This case comes from the Lahore High Court, Multan Bench, and deals with a murder trial. A prosecution witness, Manzoor Ahmad, had testified under oath that it was co-accused Riaz who fired the shots that killed the victim. Weeks later, the witness filed an application claiming this was a clerical mistake and that he actually meant to name Ejaz, the petitioner, as the shooter. The trial judge allowed the witness to be re-examined and change his testimony, and then refused the defence lawyer's request for time to challenge this decision, forcing the defence to cross-examine immediately without that opportunity.
Ejaz challenged this in the High Court. The Court ruled in his favour, holding that the law governing evidence (Article 133 of the Qanun-e-Shahadat Order, 1984) only allows a witness to be re-examined to explain something raised in cross-examination, or to address a genuinely new matter with court permission. It does not allow a witness to go back and effectively change or "correct" testimony to fix a problem in the prosecution's case. The Court also stressed that criminal trials must follow fair procedure, especially in serious cases where an accused may face the death penalty, and that an accused must get a meaningful chance to defend himself before being convicted.
As a result, the trial court's order allowing the re-examination was cancelled, along with everything that followed from it. This case matters because it reinforces that procedural fairness and safeguards for the accused cannot be bypassed even to accommodate a complainant's shifting evidence.
