Change of Investigation after submission of Challan

PLJ 2016 · Lahore High Court (Multan Bench)

This case involved a petitioner whose cousin and father had been arrested in two narcotics cases registered under the Control of Narcotic Substances Act, 1997, allegedly after drugs were planted on them due to a bribery dispute with police. The petitioner asked the Lahore High Court to direct the City Police Officer, Multan, to decide his application seeking a change of the police investigation into these cases, claiming the original probe was unfair.

By the time the matter reached court, however, the police challan (charge sheet) had already been submitted to the trial court, charges had been framed against the accused, and the trial was actively underway. The District Standing Board had also already reviewed the matter and disposed of the petitioner's application.

The High Court examined Article 18-A of the Punjab Police Order (Amendment) Ordinance, 2013, which allows transfer of investigation to a different officer under certain procedures. However, relying on a Supreme Court precedent, the Court held that requesting a change of investigating officer at such a late stage—after the challan was filed and trial had begun—was not legally sustainable.

The petition was therefore dismissed. The case clarifies that requests to change investigators under police law must generally be made early, before trial proceedings have advanced, and courts will not disturb an ongoing trial to revisit the investigation stage.
