Provisions of CPC are not applicable before Family Court

PLJ 2016 AJ&K 52 · Azad Jammu & Kashmir High Court

This case involved a family dispute over dower and maintenance in Azad Jammu and Kashmir. A wife, Lubna Sadiq, had filed a suit before the Family Court seeking dower and maintenance from her husband, Rashid Shamim. While the case was ongoing, she gave birth and applied to add her newborn child, Falak, as an additional plaintiff in the maintenance suit, also seeking recovery of birth-related expenses. The husband objected, arguing that the Family Courts Act, 1993 has no provision allowing such amendments, and that adding a new party and new claims would improperly turn a family maintenance suit into something resembling an ordinary civil suit. The Family Court allowed the amendment, and the husband challenged this decision before the High Court through a writ petition.

The High Court upheld the Family Court's decision. It explained that the Civil Procedure Code does not strictly apply to Family Court proceedings, since the Family Courts Act is a special law meant to provide speedy relief to families. However, where the Family Courts Act is silent on a procedural matter, courts may still apply general principles of justice, equity, and good conscience, drawing on CPC principles when they don't conflict with the Act. Since there was no specific bar on allowing amendments or including a family member like a minor child in a maintenance suit, and since a father is legally obligated to support his children's genuine needs, the court found no illegality in allowing the child to be added as a plaintiff. The writ petition was dismissed, meaning the original amendment order stood.
