Interpretation of Sections 5 and 14 of Limitation Act

PLJ 2016 AJ&K 19 · Azad Jammu & Kashmir High Court

This case from the Azad Jammu & Kashmir High Court dealt with a long-running property dispute and an important legal question about deadlines for challenging court decrees obtained through fraud.

The background: a woman obtained a compromise decree for land, which she later gifted to her minor son. Some other claimants, who said the land actually belonged to them, challenged the compromise decree, first through a regular lawsuit alleging fraud, which was rejected by the trial court and upheld on appeal as being legally barred. They then tried a different legal route, filing an application under Section 12(2) of the Civil Procedure Code (a special, faster remedy for cancelling decrees obtained by fraud). The original decree-holders argued this new application was filed too late and that the claimants, having already lost their earlier suit, had no standing to try again.

The High Court held that since the claimants were never made parties to the original compromise decree, they were legal strangers entitled to use the Section 12(2) remedy. It clarified that no specific limitation period is fixed by law for such applications, but Article 181 of the Limitation Act (a three-year general limitation) would apply, counted from when the party learned of the decree. The Court also explained when delay can be excused under Sections 5 and 14 of the Limitation Act - only if the wrong forum was chosen carefully and in good faith, not through gross negligence. This ruling clarifies how fraud-based challenges to decrees and limitation rules interact.
