There are four ingredients of Benami Transaction
PLJ 2015 · Islamabad High Court
This case was about a property dispute between Musa Khan, who claimed he had secretly funded the purchase of a plot in Islamabad while living in the UK, and Ashram Bibi, in whose name the plot was officially registered. Musa Khan argued this was a benami transaction, meaning the property was only held in Ashram Bibi's name on paper while he was the real owner, because he had sent the purchase money through a jointly operated bank account and she had acquired the property through misrepresentation. The trial court agreed with him and declared him the owner. Ashram Bibi appealed to the Islamabad High Court.
The High Court overturned the trial court's decision. It explained that anyone claiming a property is benami must prove four things: the source of funds used to buy the property, who held custody of the original title documents, who was actually in possession of the property, and the motive behind disguising the real ownership. The court found that Musa Khan had only argued that he provided the money, but failed to address or prove the other three essential elements, particularly possession and custody of documents, which were shown to be with Ashram Bibi. The court also noted that such claims often surface only after relationships sour, which undermines their credibility.
This judgment matters because it reaffirms the strict evidentiary standard required to prove benami ownership claims in Pakistani law, protecting registered property owners from claims based on incomplete or weak evidence.
