Stay of Execution in Rent Matter
PLJ 2015 · Lahore High Court
This case involved a landlord-tenant dispute that had already been fully decided through the courts. A Rent Tribunal in Sargodha had ordered the eviction of a tenant in 2010. The tenant appealed repeatedly, losing at every stage, including before the Lahore High Court and eventually withdrawing an appeal before the Supreme Court. This meant the eviction order had become final.
Afterward, the tenant filed a fresh civil suit claiming ownership of the property and got a temporary status quo order from a civil judge. Using this, he asked the court executing the eviction order to pause the eviction proceedings, arguing that an ownership dispute was pending. When this request was denied, he challenged that denial before the Lahore High Court.
The High Court dismissed his petition. It explained that the legal rule allowing execution to be paused while another suit is pending (Order XXI Rule 29 of the Civil Procedure Code) only applies when someone is executing a civil court decree, not an eviction order from a Rent Tribunal, which operates on a different legal basis concerning landlord-tenant relationships. The court also noted that the tenant had concealed the existence of the final eviction order in his new ownership suit, which was dishonest and disqualified him from equitable relief.
This case reaffirms that final eviction orders by Rent Tribunals cannot be stalled through unrelated ownership suits, and that courts will not assist litigants who conceal important facts.
