-If a convict has been sentenced to death as ta'zir then all legal heirs of deceased must enter into a compromise to enable compounding of offence u/S. 345(2) of Code

PLJ 2015 SC 741 · Lahore High Court

This Supreme Court judgment dealt with three separate criminal appeals of men sentenced to death for murder (qatl-i-amd), whose convictions had been upheld by the Lahore High Court. In each case, at least one legal heir of the victim had forgiven the convict or entered into a compromise, but not all heirs had agreed to do so. The central question was whether such a partial compromise, by some but not all heirs, could justify reducing the death sentence to life imprisonment.

The Supreme Court clarified that under the law, a formal compounding of the offence requires agreement of all legal heirs of the deceased. Where only some heirs compromise, this cannot automatically result in a lesser sentence. However, the Court said such partial compromise is not irrelevant either it is one factor among many that courts may consider when deciding whether to impose death or life imprisonment, since the law requires courts to weigh all facts and circumstances of the case, even where all heirs have compromised, the court retains discretion to still impose punishment.

Applying this reasoning to the facts, the Court found the murders in question to be particularly brutal, premeditated, and violent, involving family members and repeated stabbings or shootings. Despite compromises by some heirs, the Court refused to reduce the death sentences, holding that the gravity and manner of the killings did not warrant leniency. The case is significant for clarifying how compromises by victims families interact with sentencing discretion in murder cases.
