Appointment of a Civil Servant through Transfer

This Supreme Court of Pakistan judgment is a review petition arising from an earlier 2013 decision concerning irregular appointments, promotions, and transfers of civil servants in Sindh, particularly involving police officers.
The core issue was whether civil servants could be appointed to different departments or cadres through transfer, and whether police officers could receive out of turn promotions. The Court clarified that under Sindh's civil service rules, a person can only be appointed by transfer if they are actually eligible and qualified for the new post, and must be screened by the proper selection bodies. Rule 9-A, meant to accommodate employees whose posts were abolished, could not be misused to bypass these eligibility requirements by artificially abolishing someone's post just to transfer them elsewhere.
On out of turn promotions, the Court upheld its earlier ruling that such promotions for police officers violated the Constitution's provisions on equality and fair treatment, since they lacked transparent, objective criteria. However, it ordered that officers who lost such promotions should still have their seniority fixed as if the improper promotion had never happened, alongside their original batchmates.
The Court also addressed whether its earlier judgment should apply only going forward. It held that benefits gained under laws later declared unconstitutional are void from the very beginning, so no rights survive from an invalid law, meaning such benefits must be withdrawn entirely.
