Reinstatement is inevitable on acquittal of civil servant

PLJ 2015 · Lahore High Court

This case involved Muhammad Zafran, a former Warder at Central Jail Rawalpindi, who was dismissed from service after being implicated in a narcotics smuggling case. He was initially dismissed under one law, the Punjab Removal from Service (Special Powers) Ordinance, 2000. He appealed, and the tribunal earlier ordered reinstatement with a fresh, proper inquiry. However, during the new proceedings, the authorities switched to a different law, the PEEDA Act, 2006, and dismissed him again.

The Punjab Service Tribunal found several problems with this fresh dismissal. First, switching between different laws partway through the process was improper, following established Supreme Court precedent. Second, the inquiry officer never gave Zafran a chance to cross-examine the witnesses against him, making it an incomplete and unfair inquiry. Most importantly, the criminal court had already acquitted Zafran of the narcotics charges, and this acquittal was never challenged or overturned by the prosecution, so it was final.

The Tribunal held that once a civil servant is acquitted by a competent criminal court, the department cannot lawfully refuse to reinstate him. The authorities had ignored this acquittal while rejecting his appeals.

As a result, the Tribunal set aside all the dismissal orders and ordered Zafran's full reinstatement with all back benefits. This case reinforces an important protection for government employees: a criminal acquittal generally entitles them to get their job back.
