Re-investigation of decided case is not allowed

PLJ 2015 · Lahore High Court (Multan Bench)

This case concerned how police investigations can be transferred between officers under the Police Order, 2002. An FIR had been lodged over a death, and during investigation the police cleared some accused of involvement. The main accused then successfully applied to have the investigation transferred to a different officer, and later the petitioner and the accused jointly got it transferred again to another officer, with approval at the Regional Police Officer level. Later, the complainant also approached the Regional Police Officer and got the investigation changed a second time by that same officer. The petitioner challenged this latest change in the Lahore High Court, arguing the Regional Police Officer had no power to order a second transfer, and that the new team's composition also violated the law's rank requirements.

The court examined Article 18-A of the Police Order, which allows a district police chief to transfer investigation once, and the Regional Police Officer to do so a second time if asked to review that first transfer - but no provision allows repeated, open-ended transfers of investigation. The court also noted that by the time of the disputed order, a challan (charge sheet) had already been filed and the trial court had taken cognizance of the case. At that stage, reinvestigation is not legally permissible; police lose authority to reinvestigate once a court is seized of the matter. The court therefore quashed the impugned order allowing a second change of investigation.

This matters because it clarifies limits on police power to repeatedly change investigating officers, especially after a case has reached court, protecting the integrity and finality of judicial proceedings from administrative interference.
