Case must be decided with a reason even by Quasi Judicial Forums

PLJ 2015 Peshawar 55 (DB) · Peshawar High Court

This is a decision by the Peshawar High Court on a constitutional petition challenging an order of the Senior Member Board of Revenue (SMBR), Khyber Pakhtunkhwa.

Background: A land dispute involved applications for partition and for recovery of produce. The petitioners had initially been proceeded against ex-parte, and when they sought to have those orders set aside, their request failed at lower revenue forums. The Senior Member Board of Revenue then combined both related cases and decided them together in one judgment in the petitioners' favor, sending the matter back for fresh proceedings. Later, on a review petition filed by the other side, the same forum reversed course, ruling that combining the two cases into one judgment had been a mistake, and ordered them to be heard separately again.

The High Court found this review order legally flawed. It held that courts and even quasi-judicial bodies like the Board of Revenue must decide cases with proper reasoning, not arbitrarily, so that the losing party understands the basis of the decision. The Court also ruled there was no legal bar to deciding two related revision petitions through a single consolidated judgment, especially since they involved the same parties, property, and the common issue of setting aside ex-parte orders. It further clarified that review is not the same as appeal, and a review forum cannot simply re-hear a case on its merits using review as a backdoor appeal.

The petition was allowed, and the earlier consolidated judgment was restored. This case reinforces the principle that reasoned decisions are essential to fair justice, and that review powers are lim
