PLJ 2015 Lahore 951
· Lahore High Court (Multan Bench)
This case concerns a dispute over the recovery of dower (money owed to a wife under Islamic marriage law) that was filed in a Family Court twenty-three years after the husband's death.
Mst. Sakina married Allah Wassaya in 1980. The husband's family claimed he divorced her in December 1981, with the divorce becoming effective in March 1982, and that he died in October 1982. Decades later, in 2005, Mst. Sakina filed a suit for recovery of her dower. The Family Court ruled in her favor, and this decision was upheld on appeal by the Additional District Judge. The husband's heirs then challenged both rulings before the Lahore High Court.
The High Court examined the Limitation Act, 1908, which sets a three-year deadline for filing dower claims, starting either from when payment is demanded and refused, or from when the marriage ends through death or divorce. Based on the evidence, the marriage had ended either in March 1982 (divorce) or October 1982 (death). Either way, the three-year limitation period expired by 1985, decades before Sakina filed her suit.
The court held that both lower courts had failed in their basic duty to first check whether the suit was time-barred before proceeding to decide it on merits. Since the suit was clearly filed too late, the judgments of both lower courts were declared invalid and without jurisdiction. The petition was allowed, and the earlier decisions were set aside. This case underscores that courts must address limitation issues before examining a case's substance.
