This case involved a marriage dispute between Abdul Rafay Butt, an MBBS doctor, and his wife Faiza Meer, who had married in 2010 with dower fixed at gold bangles worth Rs. 350,000. Shortly after marriage, the husband went abroad for work, and the marriage broke down. The wife filed a suit seeking dissolution of marriage, return of dowry articles, dower, and maintenance. The husband agreed to end the marriage through khula (a wife-initiated divorce), and the Family Court dissolved the marriage but ordered separate proceedings on the other claims.
The Family Court ruled against the wife on maintenance and dower but partially awarded her dowry articles. On appeal, the Additional District Judge upheld the dismissal of the husband's appeal and partly allowed the wife's appeal, granting her maintenance for the iddat period (the mandatory waiting period after divorce) and dowry articles or their cash value.
The husband challenged these decisions in the High Court, arguing he shouldn't have to pay maintenance and that the wife should return the dower since the divorce was via khula. The High Court dismissed his petition. It held that factual findings by lower courts, reached through proper legal process, cannot be overturned unless there is serious injustice. The husband failed to prove he actually paid the dower at the time of marriage, as he didn't produce witnesses. The court also explained that under Islamic law, a divorced wife is entitled to maintenance during iddat, since she cannot remarry during this period
