Judgment on Quashment by Justice Athar Min Allah
PLJ 2015 · Islamabad High Court
This case involved a dispute between parties who had entered into property exchange agreements in 2012. After disagreements arose, one party filed a civil suit to stop property transfers, and shortly after, also got an FIR (criminal case) registered against the petitioners under Sections 406 and 34 of the Pakistan Penal Code, accusing them of criminal breach of trust.
The petitioners asked the Islamabad High Court to quash the FIR, arguing that the underlying dispute was purely civil in nature, arising from property exchange agreements, and that the essential ingredient of criminal breach of trust, namely entrustment of property, was not even made out from the agreements themselves. They also pointed out that the FIR was filed over a year after the alleged incident and only after the civil suit had already been initiated.
The respondents opposed this, arguing that quashing an FIR is an extraordinary remedy to be used sparingly, that alternate remedies already exist under the Criminal Procedure Code for the petitioners to seek discharge at trial, and that a pending civil case does not automatically bar criminal proceedings.
The court decided not to quash the FIR itself. Instead, it held that the question of whether property was truly entrusted should be examined by the trial court, which has proper mechanisms to decide this. The High Court exercised judicial restraint, directing the petitioners to pursue alternate remedies before the trial court rather than deciding the factual dispute itself. This shows courts' cautious approach to using constitutional powers to stop criminal cases prematurely.
