Duty of Care is Legal Duty owed by employer towards employee
PLJ 2015 · Islamabad High Court
This case, decided by the Islamabad High Court, dealt with a wave of petitions filed by employees of the Capital Development Authority (CDA) and similar organizations, who were asking the court to step in and resolve disputes over their terms and conditions of service, such as disciplinary actions and service grievances. Since these employees were not civil servants, they could not approach the Federal Service Tribunal and had no other effective forum, so they were forced to invoke the High Court's extraordinary constitutional jurisdiction under Article 199.
The court held that employers, including government-controlled bodies like CDA, owe a legal "duty of care" to their employees, similar to duties recognized between doctors and patients or lawyers and clients. This duty requires employers to protect employees from harm and to provide fair, affordable, and quick ways to resolve workplace disputes. Failing to provide such mechanisms, the court said, breaches this duty of care and violates employees' fundamental rights, particularly the right to access justice, which is tied to the right to life under Article 9 of the Constitution.
The court noted that forcing employees to seek relief only through High Court litigation is neither affordable nor accessible, especially for lower-grade staff. It directed the government and its organizations to justify why they haven't created independent, affordable, and impartial tribunals for employees, and praised CDA's steps toward establishing such a grievance-redressal forum, calling it a move in the right direction.
