Case Law on Birth Verification of a Student
PLJ 2015 · Lahore High Court
This case involved a dispute over admission to the MBBS program at Sheikh Zayed Medical College, Rahimyarkhan, through a seat specially reserved for Cholistani students. Two candidates, Murad Ali Khan and Tehreem Fatima Lashari, both claimed entitlement to this single reserved seat on the basis of being Cholistani by birth.
Initially, Lashari's name appeared on the merit list, but it was later replaced by Khan's name without any notice to her. She challenged this change through a writ petition before a Single Judge of the Lahore High Court, arguing that Khan's claim to Cholistani origin was not genuine, since his documents had gaps, such as blank entries regarding place and date of arrival in his domicile certificate, and no record of his birth in the relevant Cholistan birth registration record. The Single Judge agreed and restored the original list favoring Lashari.
Khan then filed an Intra Court Appeal against this decision. However, the Division Bench ruled that the appeal itself was not legally permissible. It held that under the University of Health Sciences Ordinance, 2002, an internal remedy of revision was available against admission decisions, and such a revision had already been filed and allowed by the university authorities. Because of this, under Section 3(2) of the Law Reforms Ordinance, 1972, a further intra-court appeal was barred.
This judgment highlights how procedural remedies and proper documentation of eligibility criteria, especially for reserved seats meant for specific communities, are strictly scr
