Bail Granted on Medical Ground
PLJ 2015 · Peshawar High Court
This case involved Pir Muhammad Azam, who was facing accountability proceedings before the National Accountability Bureau on corruption-related charges. His first bail request had already been rejected by the Peshawar High Court in an earlier case. He then approached the court again, this time seeking bail purely on medical grounds, pointing out that in a separate but related criminal case, the same court had already granted him bail because of his serious health condition.
Medical reports showed that the petitioner suffered from chronic obstructive pulmonary disease (COPD), with severe breathing difficulty requiring urgent treatment, ideally in an intensive care unit. A prison medical officer's report confirmed that the jail hospital lacked the specialized facilities and equipment needed to properly treat his condition, despite repeated hospital referrals.
The National Accountability Bureau opposed bail, arguing the jail could provide adequate care, but could not dispute that the petitioner had already been released on bail on identical medical grounds in another case.
The High Court held that once it is established that an illness cannot be properly treated inside jail and requires specialized care, the accused is entitled to bail regardless of the seriousness of the alleged offence. Relying on established Supreme Court precedents, the court ruled that gravity of illness can outweigh gravity of the charges, and granted bail on medical grounds, noting prosecution could later seek cancellation if the petitioner's health improved.
