A person may be owner but not a landlord

PLJ 2015 · Peshawar High Court

This case from the Peshawar High Court dealt with a dispute between a man claiming to be a landlord and another he wanted evicted for allegedly defaulting on rent. The landlord filed for eviction under the Urban Rent Restriction Ordinance, 1959, but the tenant denied that any landlord-tenant relationship existed between them at all.

The Rent Controller initially sided with the tenant and dismissed the eviction petition, finding no proof of a tenancy relationship. However, an appellate court reversed this, relying heavily on a decision from an informal mediation body called a Musalehati Committee, where the tenant was said to have admitted he was indeed a tenant.

The High Court disagreed with the appellate court's reasoning. It found that the landlord's witnesses could not produce any rent receipts, utility bills, or even a tenancy agreement, nor could they recall specific details of alleged rent payments. The Court also noted that no one from the mediation committee was called to testify about what actually happened there, so the claim that the tenant admitted tenancy remained unproven.

The Court emphasized an important legal principle: owning a property does not automatically make someone a "landlord" in the legal sense, and the real issue in eviction cases is whether a landlord-tenant relationship exists, not who holds title to the property. Since this relationship wasn't proven, the High Court restored the original ruling dismissing the eviction case.
