Suit for Damages on Malicious Prosecution can be filed within one year

PLJ 2014 · Sindh High Court

This case involves a suit for damages for malicious prosecution, filed against Habib Bank Ltd and others by two plaintiffs. The plaintiffs claimed their prosecution had been malicious, and they sought compensation after being acquitted. However, the law sets a strict one-year time limit for filing such suits, counted from the date of acquittal. The trial court had dismissed the suit as time-barred, since it appeared to have been filed more than a year after the plaintiffs were acquitted.

The plaintiffs later asked the Sindh High Court to recall and review that dismissal, arguing that the court had overlooked an important legal protection: Section 4 of the Limitation Act. This provision allows a suit to be validly filed on the very first day a court reopens after being closed, if the limitation period expired during the closure. The plaintiffs argued their suit was filed on the first working day after summer court vacations, meaning it was not actually late.

The Court agreed. It held that Section 4 does not extend the limitation period, but it does protect suits filed on the first reopening day when the deadline fell during vacation. Since this point had been missed earlier, the dismissal judgment and decree were recalled and reviewed.

This case matters because it clarifies that litigants who file on the first day courts reopen after a vacation should not be unfairly penalized for court closures beyond their control.
