Section 195 and 476 do not bar police to lodge FIR
PLJ 2014 · Lahore High Court (Rawalpindi Bench)
This case is from the Lahore High Court, Rawalpindi Bench, dealing with whether a criminal case could be registered by police over an allegedly forged document that had been used as evidence in an earlier civil lawsuit.
The background: Rashid Javed had sued Aamir Shahzad for recovery of money, relying on a document called an "Iqrarnama" (agreement) dated 2006. The civil court found this document to be forged and dismissed the suit. The complainant, Aamir Shahzad, then got an FIR (police case) registered against Rashid Javed and others for fraud and forgery under the Pakistan Penal Code. Javed challenged this FIR, arguing that under Section 195(1)(c) of the Criminal Procedure Code, only the court before which the forged document was produced could authorize such prosecution - not the police directly.
The High Court disagreed and dismissed the petitions. It held that Section 195(1)(c) only restricts courts from taking cognizance of such offences without proper authorization; it does not stop the police from registering an FIR and investigating. More importantly, since the forgery was allegedly committed in 2006 - before the lawsuit was even filed in 2009 - this legal restriction didn't apply at all, because the restriction only covers forgery committed during or in relation to ongoing court proceedings, not before them.
This ruling clarifies that victims of document fraud can approach police directly for an FIR when the forgery predates any court case, without needing special court permission first.
