Even Mental Torture is Cruelty in Matrimonial Relations
PLJ 2014 SC (AJ&K) 102 · Azad Jammu & Kashmir High Court
This case was an appeal before the AJ&K Supreme Court concerning a marital dispute. Shamaila Bibi had sought dissolution of her marriage from her husband Abdul Hafeez, along with recovery of dower, dowry, and maintenance, alleging cruelty, false accusations of bad character, physical mistreatment, and being thrown out of the house. The husband denied this, claiming the real dispute was over an unpaid loan his father owed her father, and he separately sued for restitution of conjugal rights.
The Family Court had earlier granted dissolution of marriage and ordered recovery of dower and dowry, while dismissing claims for maintenance and restitution of conjugal rights. On appeal, the Shariat Court partly modified this, upholding dissolution on grounds of cruelty and non-payment of dower, while maintaining the dowry recovery decree.
The husband further appealed, arguing there was no real evidence of cruelty and that inconsistencies in the wife's account undermined her claims. The Supreme Court disagreed, holding that cruelty in matrimonial cases does not require physical injury - false allegations damaging a spouse's reputation and causing mental torture and loss of mutual trust also qualify as cruelty. The court upheld the dissolution of marriage, the recovery of deferred dower (since the husband failed to transfer the promised house), and the dowry recovery decree, since the wife proved these items remained with the husband.
This judgment matters because it affirms that mental and emotional harm, not just physical viol
