Judgment on Section 8 of Code of Civil Procedure

PLJ 2014 SC 835 · Peshawar High Court

This case involved a long-running land dispute over property in Nodeh Bala, Pakistan. The appellants (descendants of Qudratullah) claimed ownership based on a 1938 sale deed through which their father bought land from Mst. Marjan, plus a 1944 mutation recorded in his favor. However, Mst. Marjan had earlier, in 1939, filed a separate suit for possession of the same land, and in 1940 obtained an ex-parte decree (a ruling made without the other side appearing) granting her possession, since Qudratullah had been proceeded against ex-parte and failed to contest.

The core legal question was whether this 1940 possession decree remained valid and binding, given that the sale deed itself was never directly challenged in that earlier suit, and whether the appellants could still rely on the sale deed to claim ownership.

The Supreme Court held that an ex-parte decree is just as legally valid and binding as a contested one, differing only in the methods available to challenge it. Since the appellants never took direct legal action to set aside the 1940 decree, it became final and binding on them. The Court further explained that in suits for possession under Section 8 of the Specific Relief Act, a declaration of entitlement to possession inherently includes a declaration of title. Therefore, even though the sale deed wasn't explicitly challenged, the possession decree effectively overrode it, rendering the sale deed legally ineffective. The appeal was dismissed.
