Fauji Fertilizer V. NIRC .. Illegal lockout challenged in Judgement
PLJ 2014 SC 69 · Sindh High Court
Fauji Fertilizer Company (formerly Pak Saudi Fertilizer) hired contractors over the years to bag, load, and handle its urea fertilizer. The contractors employed their own workers, who eventually formed a union recognized as the bargaining agent. When a dispute arose over a new contractor and reduced wages under a fresh settlement, the union alleged the workers were illegally locked out to pressure them into accepting worse terms, and sought reinstatement through the National Industrial Relations Commission (NIRC). The company argued there was no employer-employee relationship between it and the contractor's workers, so the lock-out provisions did not apply to them.
The Supreme Court disagreed with the company. It held that where a company retains control over how contracted work is actually performed, the workers are effectively its employees, even if hired through a contractor. Since these workers were directly supervised by the company and performed core functions like bagging and loading, they were considered company employees for legal purposes. The lock-out was therefore illegal, and the union had rightly challenged it. The Court upheld the Labour Appellate Tribunal's decision ordering reinstatement, though it clarified back-benefits would only apply until the relevant settlement's expiry, after which the workers had already attained permanent status by length of service. The appeals were dismissed.
This case matters because it protects contract laborers from being denied basic labor rights just because they're technically hired through a third party, when in reality they work under the direct control of the principal company.
