Contempt Proceedings against Chief Secretary Sindh

PLJ 2014 SC 331 · Supreme Court of Pakistan

This case concerns a major Supreme Court review of how civil servants were appointed, transferred, and absorbed into government service in Sindh. The petitions challenged various laws and practices, including the Chief Minister's power to appoint officers to posts like Assistant Commissioner by transfer beyond his prescribed quota, and laws allowing employees from other organizations to be "absorbed" into civil service cadres with backdated seniority, bypassing the normal competitive examination process.

The Supreme Court found these practices unconstitutional. It held that appointments made in excess of the Chief Minister's quota disrupted the legitimate seniority of officers who had earned their positions through competitive examinations, and ordered such officers reverted to their original posts. The Court also struck down legislation (including the Sindh Civil Servants Regularization of Absorption Act and related ordinances) that allowed non-civil servants to be absorbed into government service with backdated seniority without competing through proper recruitment. The judges reasoned that this deprived genuine civil servants of their constitutional rights to status and reputation, encouraged nepotism and corruption, and violated principles of equality under the Constitution.

This judgment matters because it reinforces that government appointments and promotions must follow merit-based, transparent processes rather than political patronage. It protects the rights of civil servants who qualify through proper competitive procedures and sets limits on executive power to manipulate civil service rules for favoritism, reinforcing constitutional safeguards against arbitrary governance.
