Iftikhar Chodhary's decision in a Guardian Case

PLJ 2014 SC 157 · Balochistan High Court

This case involved a custody dispute over a young girl named Najla Bugti, whose parents divorced in 2000. After the divorce, the mother, Shabana Naz, kept custody of the child. The father, Muhammad Saleem, later applied to a family court to be made the child's legal guardian, arguing that the mother had remarried a man unrelated to the child, which under Islamic law affects a mother's custody rights. The family court and appellate courts ruled in the father's favor, and the mother challenged this all the way to the Supreme Court of Pakistan.

The mother argued that the father had failed to pay maintenance for the child and had also remarried, so he should not get custody either. The Supreme Court, led by Chief Justice Iftikhar Muhammad Chaudhry, examined the evidence and found that the father had in fact been providing maintenance regularly, a claim the mother had not seriously disputed during the trial.
