Quashment Dismissal Judgment

PLJ 2014 · Peshawar High Court

This case involved Murad Gul, who was booked under narcotics law after police allegedly caught him with 650 grams of chars (hashish) in Peshawar. He threw away a shopping bag containing the drugs and fled when a police patrol stopped him, according to the FIR.

Gul asked the Peshawar High Court to quash the FIR against him, arguing that the complainant had acted out of malicious intent and that there was nothing connecting him to the crime, and that he had no prior criminal history.

The High Court dismissed his petition. It explained that its special inherent power to quash cases (under Section 561-A of the Criminal Procedure Code) is meant only for extraordinary situations, not as a routine alternative to a full trial. The court noted that police had already completed their investigation and filed a formal charge sheet, and the case was already before a trial court. It held that allegations of bad faith by police cannot be used to shut down a case before the prosecution gets a chance to present its evidence, since deciding whether evidence is reliable is the trial court's job, not the High Court's. The judge pointed out that Gul still had the option to seek acquittal during the trial itself if the evidence turned out to be insufficient.

This case illustrates how Pakistani courts are generally reluctant to stop criminal trials early, preserving that power only for truly exceptional circumstances.
