Presumption of Correctness: Article 100 of QSO
PLJ 2014 · Peshawar High Court
This case concerns a long-running property dispute over a small house in Charsadda, District Peshawar, involving competing claims based on a gift deed and inheritance rights.
Muhammad Israr claimed ownership of the house through a registered gift deed, allegedly executed in his favour by his maternal grandmother, Mst. Kishwara, in 1997. Jehanzeb and other relatives disputed this, arguing the house actually belonged to one Masaib Shah and should be divided among his legal heirs according to Islamic inheritance shares. After multiple rounds of litigation, including a case reopened under Section 12(2) of the Civil Procedure Code due to procedural irregularities, the trial court ruled in favour of Jehanzeb and the heirs, but the appellate court reversed this and upheld Israr's claim based on the gift deed.
The Peshawar High Court, hearing a revision petition, examined whether old or registered documents automatically deserve a "presumption of correctness" under Article 100 of the Qanun-e-Shahadat Order (Pakistan's law of evidence). The Court held that merely being registered or old does not automatically prove a document's authenticity, especially when its execution is seriously challenged. The beneficiary of such a document must still prove it was properly executed, including requirements like offer, acceptance, and delivery of possession for a valid gift. Since Israr failed to produce key witnesses or sufficiently prove these elements, the High Court found the appellate court's reasoning flawed.
