Evidence Act: Correctness of document test

PLJ 2014 Peshawar 26 · Peshawar High Court

This case involved a property dispute from Mardan district. The plaintiffs claimed ownership of agricultural land, arguing their title stemmed from a 1926 compromise decree in an old pre-emption lawsuit, which they said was later confirmed through a 1964 agreement. The trial court and the first appellate court both ruled in the plaintiffs' favor, relying heavily on the age of these documents, treating them as presumptively genuine under the thirty-year-old document rule in the Qanun-e-Shahadat Order (Pakistan's evidence law).

The Peshawar High Court overturned these decisions. It held that merely because a document is old does not automatically make it reliable or true. Courts must also examine whether the document actually came from proper custody and whether it was genuinely signed by the person it claims to be from. More importantly, the court pointed out that the lower courts failed to actually read and understand what the documents said. The 1926 decree was from a pre-emption suit that was dismissed by compromise—it did not establish ownership or title at all. The 1964 agreement contradicted the 1926 decree and was not even a public document, so it couldn't automatically enjoy the same presumption of genuineness.

The High Court found the plaintiffs' suit was actually time-barred and essentially a retaliatory lawsuit. It set aside both lower court decisions, ruling they were legally and factually unsustainable. This case highlights that courts cannot blindly apply presumptions of correctness to old documents without examining their actual content and context.
