Oral Sale Transaction Judgment

PLJ 2014 · Lahore High Court

This case involved a dispute over land in Narowal after the death of Din Muhammad, the original owner. A mutation (record of land transfer) dated 12 April 1995 showed that Din Muhammad had orally sold his land to Muhammad Asghar shortly before his death. After Din Muhammad died, his legal heirs filed a lawsuit claiming he was mentally unwell at the time and lacked the capacity to make such a transaction, and that the sale was fraudulent and without real payment.

Both the trial court and the first appellate court ruled against the person claiming to have bought the land, finding that the deceased was mentally disordered and that the sale was not genuinely proven. The buyer then approached the Lahore High Court, also asking for permission to bring new witnesses (two local lumberdars) to prove the deceased had identified himself as the person making the sale.

The High Court refused to allow this late additional evidence, holding that such evidence is meant to help the court reach a fair decision, not to let a losing party fix gaps in their original case long after the opportunity had passed. Since the buyer failed to produce solid proof of payment or of the deceased's free consent, and since two lower courts had already agreed on the facts, the High Court upheld their decisions and dismissed the case, confirming the land rightfully belonged to the deceased's heirs.
