Mechanism for trial of matrimonial and family dispute between spouse

PLJ 2014 · Peshawar High Court

This case is about a wife who sued for dissolution of her marriage, dower, maintenance, and dowry articles, claiming her husband was cruel and infertile, and had hidden his infertility from her before marriage. The Family Court dissolved the marriage, reasoning that concealing infertility amounted to cruelty, and awarded her part of her dower and maintenance. On appeal, the Additional District Judge disagreed with that reasoning but still dissolved the marriage, changing the basis from cruelty to khula (a wife-initiated separation), while also granting her the dowry articles she sought. The matter eventually reached the Supreme Court, which sent it back to the Peshawar High Court for a fresh decision.

The High Court held that the wife herself admitted she knew about her husband's infertility before marriage, and she could not prove ongoing cruelty or that infertility was still an issue. Since infertility is not a recognized ground for divorce under the Dissolution of Muslim Marriages Act, 1939, and is simply a natural condition beyond human control, it could not justify dissolution on that basis. However, the court reaffirmed that even if a wife fails to prove the specific grounds she claims, she can still be granted separation through khula if she is unwilling to continue the marriage, since Islamic law does not compel spouses to remain in a marriage devoid of harmony.

This judgment matters because it clarifies that family courts can grant khula as a fallback remedy even when a wife's stated grounds for divorce (like cruelty or infertility) aren't pro
