Signature Verification by Handwriting Expert

PLJ 2014 Lahore 193 · Lahore High Court

This case involved a dispute over a suit for specific performance of an agreement to sell property, dated 19.06.2004. The petitioner, Talib Hussain, claimed that Respondent No. 3 had sold him the property and signed and thumb-stamped the agreement after receiving full payment. Respondent No. 3 denied signing the document or placing his thumb impression on it. The petitioner asked the trial court to have the disputed signature and thumb impression compared with genuine specimens by handwriting and fingerprint experts. Both the Civil Judge and the Additional District Judge rejected this request, mainly because evidence had already been recorded and the case was close to final arguments.

The Lahore High Court disagreed and allowed the petition. It held that under Article 84 of the Qanun-e-Shahadat Order, 1984, courts have clear power to order comparison of signatures and thumb impressions to reach a fair decision, especially since fingerprints are unique to each individual and expert reports assist courts in reaching accurate conclusions. Since this was a case of outright denial rather than a claim of fraud or coercion, the court found no valid reason to refuse the comparison. It ruled that forensic verification would not prejudice either party, since expert reports remain open to challenge, and that some delay is preferable to a hasty, potentially wrong judgment. The court set aside the lower courts' orders and directed that the comparison be carried out. This case affirms that courts should use available forensic tools to ensure just outcomes rather than rushing decisions on disputed documents
