Once divorce is pronounced it is divorce

PLJ 2014 Lahore 1054 · Lahore High Court (Rawalpindi Bench)

This case involved a dispute over inheritance rights following the death of Syed Gulzar Hussain Shah. Mst. Asghar Bibi and another petitioner filed a suit claiming a share in his property through partition, but the respondents argued she was not entitled to inherit because Gulzar Hussain Shah had divorced her back in 1971, meaning she was no longer his wife when he died. Both the trial court and the appellate court had ruled against her on this point, finding that she had indeed been divorced, based on a written divorce deed (talaqnama) supported by witness testimony, including an admission from her own relative that she had been divorced.

On revision before the Lahore High Court, her lawyer argued the divorce was invalid because it was never formally reported to the local Union Council as required under Section 7 of the Muslim Family Laws Ordinance, 1961. The court rejected this argument, holding that Islamic law does not require any specific procedure for pronouncing divorce - it can be oral or written, and a written divorce becomes irrevocable. Failure to send the required notice to the Union Council does not undo a divorce that has actually taken place, since requiring such notice to invalidate a divorce would conflict with Islamic principles.

The court also noted that the evidence strongly supported the divorce and that she had never properly denied it in her own testimony. The revision was dismissed, confirming she could not inherit as a wife.
