Jurisdiction of High Court to grant or refuse Injunction

PLJ 2014 · Balochistan High Court

This case arose from a business dispute between Dalda Foods and a distributor, Agha Arshad, over an agreement dated May 2007. The distributor sued for specific performance of the agreement and recovery of over sixty lakh rupees, and also sought an interim injunction to restrain the company from acting against him while the case was pending. The trial court granted this temporary restraining order. The company and another respondent then applied under Section 34 of the Arbitration Act, asking the court to stay the suit and refer the dispute to an arbitrator as per the agreement's arbitration clause. They also appealed the injunction order to the High Court.

The Balochistan High Court dismissed the appeal. It held that courts retain the power to grant interim injunctions even when a request has been made to refer a dispute to arbitration, because arbitrators have no power to issue such injunctions and ordinary civil procedure rules do not apply to arbitration proceedings. Simply filing an application to stay proceedings and go to arbitration does not stop the trial court from deciding an injunction request. The court also noted that since the injunction order was only temporary and not yet finally decided, the company could raise its objections before the trial court, which should resolve the matter under the normal injunction rules.

This case clarifies that seeking arbitration does not block courts from granting urgent interim protection to parties during litigation.
