Jurisdiction is important in guardian cases

PLJ 2014 · Peshawar High Court

This case involved a custody dispute over an 11-year-old boy, Amaan Hassan, between his parents. The mother had filed a petition in the Guardian Judge's court in Islamabad seeking custody of the child under the Guardians and Wards Act, 1890. The father objected, arguing that the Islamabad court had no jurisdiction to hear the case, since the family had never actually lived there together. The couple had lived in Peshawar, then Lahore, and eventually settled in Abu Dhabi.

The Guardian Judge in Islamabad rejected the father's objection, reasoning that courts where a wife resides generally have jurisdiction over such matters. The father challenged this decision before the Peshawar High Court.

The High Court examined the relevant law, particularly Rule 6 of the Family Courts Rules, 1965, which says jurisdiction belongs to the court where the cause of action arose, or where the parties reside or last resided together. Relying on a Supreme Court precedent, the Chief Justice held that since the mother never lived in Islamabad and the family had no connection to that city, the Islamabad court had no jurisdiction to hear the custody case.

As a result, the court set aside the Islamabad Guardian Judge's order and directed that the mother's petition be filed instead before a court that actually has proper jurisdiction. This case highlights that in custody and guardianship disputes, choosing the correct court based on where the parties actually lived is a crucial legal requirement, not a mere technicality.
