High Court cannot Quash FIR once challan is presented in Trial Court

PLJ 2014 · Lahore High Court (Multan Bench)

This case involved a murder FIR lodged against several accused, including Muhammad Asghar, who was alleged to have instigated and abetted the killing of a man and his wife. After the police investigation, the trial court took up the case, framed charges against some accused, and the complainant testified, naming the petitioner as the instigator. Due to a clerical or typographical slip, the petitioner's name was accidentally left out of an earlier summoning order, though it was later included and he was eventually charged along with the others.

The petitioner approached the Lahore High Court asking it to quash the proceedings against him, arguing that he had never been properly summoned and that no clear charge had been framed against him, so the case should be dropped.

The High Court refused to quash the FIR or the proceedings. It held that once a challan (police report) has been submitted and the trial court has taken cognizance of the case, the High Court should not interfere using its inherent powers under Section 561-A of the Criminal Procedure Code, relying on a Supreme Court precedent. Instead, the court said the petitioner could seek relief by applying to the trial court itself for premature acquittal under Section 265-K of the Cr.P.C.

This case matters because it reinforces the principle that once a criminal trial is underway in the trial court, higher courts should generally not intervene to quash cases; such matters should be resolved within the trial process itself.
