Fugitive from law loses some of his rights
PLJ 2014 · Peshawar High Court
This case involved a bail application before the Peshawar High Court by a man named Azizur Rehman, who was accused of murdering Suleman Shah. According to the First Information Report, the complainant, the victim's mother, witnessed the accused shoot her son with a pistol in broad daylight during a confrontation rooted in a pre-existing blood feud between the families. The accused had already been refused bail twice by lower courts and approached the High Court seeking the same relief.
His lawyers argued there was a delay in filing the police report, that medical evidence contradicted the complainant's account, that no independent witnesses existed, and that a separate police report suggested the killing may have resulted from crossfire between rival groups since the victim was allegedly a drug dealer.
The court rejected these arguments. It found the complainant's account direct, consistent, and supported by physical evidence like a bullet casing and bloodstains. It also noted that the alternative police theory was unsupported by actual evidence and that courts are not bound to accept police claims at face value. Significantly, the accused had evaded arrest for over a year, was declared a proclaimed offender, and the trial had already begun with witnesses testifying in his absence.
The court held that a person who flees from the law loses certain normal legal protections, and bail can be refused simply because of this absconding, regardless of the case's other merits. The bail petition was dismissed.
