Formal Preliminary Decree is mandatory at times

PLJ 2014 · Lahore High Court

This case involved a dispute between three brothers over property left by their father, a retired judge. One brother filed a suit asking the court to divide ("partition") property that had been gifted by their father to all three sons in equal shares through a registered gift deed. One brother contested the suit, while another agreed with it.

The brother challenging the suit tried to get the case thrown out by arguing that the plaintiff had not properly filed a list of witnesses as required by law. The trial court rejected this attempt and, since all parties had effectively admitted that the property was jointly owned in equal one-third shares (based on the admitted gift deed), the trial court went ahead and issued an order equivalent to a "preliminary decree" declaring the shares, without taking further evidence.

The challenging brother approached the High Court, arguing that a preliminary decree could not be passed without first recording evidence after issues were framed. The High Court disagreed, holding that when parties have already admitted the key facts (joint ownership in equal shares), no evidence needs to be recorded, and a preliminary decree can validly be passed at that stage.

However, the High Court noted one technical flaw: the trial court had not prepared a formal, properly drafted preliminary decree document. It dismissed the petition but directed the trial court to prepare this formal decree to fix that procedural gap. The case clarifies that while courts can decide partition shares based on admissions without full trials, they must still formally document the decree.
